This English version is a translation of the Japanese original. If there is any discrepancy between the two, the Japanese version prevails.

1. Scope

These Terms set out the conditions for using the app "SubQuest" (the "App") provided by FunnyFingers ("we", "us"). By using the App, you are deemed to have agreed to these Terms.

2. What the App is

The App offers you small actions ("Quests") and lets you keep a record of completing them.

A Quest is a suggestion, not an instruction. Whether to do it is up to you.

3. Important requests about safety

This is the most important section of these Terms.

Quests include activities outdoors. The decision to do a Quest, and responsibility for the outcome, are yours.

Please:

• Put your own safety first. Check the weather, the time of day, how you feel, and your surroundings. If it seems unreasonable, don't do it.
• Follow the law and the rules of the place. Do not enter restricted areas or private property without permission.
• Don't cause trouble for others. Be careful about whether photography is allowed, about noise, and about blocking the way.
• Watch out for traffic. Don't look at your screen while walking.

There is no need to rush to complete a Quest. Records whose deadline has passed can be recovered later.

We are not liable for damage arising from your doing a Quest, except where caused by our intent or gross negligence. Where we are liable, the scope is as set out in Section 10.

4. Your records

4.1 Records cannot be changed later

Achievement records (photo, comment, date and time of completion) cannot be changed or deleted after they are recorded (except when you delete your account). This is to keep the experience as it was at that moment.

Only the visibility setting and the favorite mark can be changed later.

4.2 Photos and comments

You provide the photos and comments. Please do not include:

• Photos of other people recorded without their consent
• Anything illegal or that infringes the rights of others
• Anything that identifies your home or workplace (especially when sharing outside the App)

Records whose visibility is set to "Friends" are visible to your friends, and records made in a Party Quest are visible to that Party's participants. Participants are not necessarily your friends.

4.3 Rights to your records

You keep the rights to your photos and comments.

You grant us, free of charge, permission to use your photos and comments to the extent needed to provide the App (storing them, showing them to friends and others, and creating images for sharing). We do not use them for any other purpose (such as advertising).

4.4 Sharing outside the App

The App has a feature for sharing your own records to outside services. There is no feature for sharing a friend's records outside the App.

Once shared, content cannot be taken back. Please check what is included before sharing.

4.5 Interacting with friends

The App has friends, sending Quests, and Party Quests. Your display name, icon image, and the note you attach to a Quest are visible to other users.

• Please do not use a display name, icon image, or note that other users would find offensive.
• You can block anyone you don't want to interact with. They are not told that you blocked them.

5. Age requirement

The App is not intended for children under 13.

The App includes activities outdoors. For this reason, it is intended for ages 13 and up.

If you are a minor, please use the App with the consent of a parent or guardian.

6. Accounts

• You can start using the App without creating an account. In that case, your records cannot be carried over if you change devices.
• By later linking an email address, Apple, or Google, you can carry over your records.
• If you delete your account, all your records are deleted. This cannot be undone.

7. Prohibited conduct

The following are prohibited:

• Manipulating the App's systems to obtain achievements or rewards
• Harassing or stalking other users, or discriminatory or sexual expression
• Impersonating others
• Inviting other users to business, solicitation, religious activities, or similar matters unrelated to the App
• Infringing the rights of other users, third parties, or us
• Interfering with the operation of the App
• Anything that violates the law or public order and morals

If we determine that a user has engaged in such conduct, we may, without prior notice, reset their display name and icon image, suspend their use of the App, or delete their account.

8. In-app currency and rewards

The App has an in-app currency (Coins) and experience points (XP).

• Coins can be earned by completing Quests, and can also be purchased through in-app purchase on the App Store / Google Play.
• Coins and XP cannot be exchanged for money or transferred. Purchased Coins are not refunded, except as required by law and refunds by the store.
• Purchased Coins do not expire. However, if you delete your account, any remaining Coins (including purchased ones) are lost.
• When you spend Coins, earned Coins are used first.
• You cannot buy achievements themselves. What Coins get you are chances to meet Quests, chances to recover cards you missed, themes, active Quest slots, and the like. XP, Traveler Lv, and Memories cannot be purchased.
• Values and prices may change to improve the App.
• About purchased Coins (prepaid payment instruments under Japan's Payment Services Act)

9. Changes to and suspension of the App

We may change the content of the App or stop providing it. For important changes, we will give notice in advance where possible.

If we end the App, we will announce it in advance and refund unused purchased Coins in accordance with the law.

10. Disclaimer

The App is provided as is. We do not guarantee that the App fits any particular purpose of yours, or that it will be free of defects or interruptions.

Where we are liable to compensate you for damage, the amount is limited to the total you paid for the App in the 12 months before the damage occurred. This limit does not apply where we acted with intent or gross negligence.

11. Changes to these Terms

We may change these Terms as needed. If we make important changes, we will announce them in the App or on this page.

12. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction, as the court of first instance, of the district court having jurisdiction over our location.
